These General Terms and Conditions and the House Rules (hereinafter referred to as “GTC”) forming Annex 1 contain the general terms and conditions and house rules for the use of the AppInGym Fitness Center (hereinafter referred to as “Fitness Center”) operated by AppInGym Kft (hereinafter referred to as “Service Provider”) at the Agora Budapest Office Building, 1113 Budapest, Esztergomi út 41. B. Building 2, ground floor, as follows:

DEFINITIONS

1.1 For the purpose of interpreting these GTC and House Rules, as well as for the purposes of the legal relationship established on the basis of the Individual Contract, the following terms shall have the following meanings:

“AppInGym Application”: the application for entering the Fitness Center and The AppInGym application, which enables the use of the Service – available from Google Play or AppStore.

“Price List” is a price list containing the prices of each Service in force at all times, which is published from time to time on the Service Provider’s Website and in the AppInGym Application.

“Opening Hours Outside of General Opening Hours”: has the meaning specified in Section 7.1.2 of these GTC.

“Trainers”: the Service Provider’s current contracted partners providing services in the Fitness Center, as trainers.

“Individual Contract”: a contract concluded between the Service Provider and the Guest in accordance with the provisions of these GTC, relating to the use of the Services.

“Fitness Center”: the AppInGym Fitness Center operated by the Service Provider at the Agora Budapest Office Building, 1113 Budapest, Esztergomi út 41. B. Building 2, ground floor.

“Website”: the Service Provider’s website located at “https://appingym.hu”.

“Separate Agreement”: has the meaning specified in Section 5.4 of these GTC.

“Services”: has the meaning specified in Section 3.1 of these GTC.

“Service Provider”: AppInGym Kft (registered office: 1112 Budapest, Menyecske utca 37. 3. em. 22.;

company registration number: 01-09-351526; tax number: 27276068-2-43).

“Guest”: any person who uses the Services of the Service Provider in any form.

“Corporate Rentals”: has the meaning set forth in Section 5.4 of these GTC.

THE PARTIES, SCOPE OF THESE GTC

TICKET AND PASS

Services can only be accessed by purchasing a ticket or a pass.

The Service Provider will inform Guests and business partners of the available ticket and pass options and their current terms in this Terms and Conditions document and any amendments thereto.

Ticket and pass types:

• Ticket: A single-entry ticket that allows access to the services during opening hours for a period of 24 hours from the entry time.
• Passes:
  • 10-session pass, valid for 90 (ninety) days,
  • 30-day pass, valid for 90 (ninety) days,
  • 3-month pass, valid for 90 (ninety) days, and
  • 1-year pass, with validity starting from the specified start date during the purchase.

During the validity period of the passes, the registered Guest (the pass holder) is entitled to unlimited access, except for the 10-session pass.

The Service Provider also issues corporate passes based on specific cooperation agreements (hereinafter: “Special Agreement”) with partner companies. The conditions of use, validity, and eligible users of these corporate passes are specified in the Special Agreements with partner companies. Unless otherwise stated in the Special Agreement, the provisions of this Terms and Conditions and House Rules apply to corporate passes and the Guests using them. Any contractual provisions from the partner company that differ from the Terms and Conditions or House Rules will not be considered part of the Special Agreement or the individual contract for the corporate passes.

Ticket and pass purchases and payment method:

Tickets and passes can only be purchased through the Service Provider’s website or the AppInGym application after registration, via smartphone, and only by credit card or electronic payment according to the procedure outlined on the website or in the AppInGym application. The full price of the service, as listed on the price list, must be paid in one lump sum. The Service Provider will issue an invoice for every purchase.

Online credit card payments are processed via the “Stripe” system. The card details are not transmitted to the merchant. The service is provided by Stripe Payments Europe, Limited.

The data provided during registration will be stored in the Service Provider’s system as outlined in the privacy notice.

When paying in currencies other than HUF, the exchange rate of the Hungarian National Bank on the day of payment will apply.

After purchasing a ticket or pass on the website or the AppInGym application, a unique QR entry code will be generated, which will be sent electronically to the Guest’s phone. This code can be used to enter and exit the Fitness Center via automatic gates.

The Service Provider is not responsible for any issues or errors caused by incorrect or inaccurate order data provided by the Guest.

Service access and hours of operation:

The Fitness Center operates with the following hours:

• Weekdays from 9:00 AM to 9:00 PM, during which the reception is open, and staff are available.
• Weekdays from 9:00 PM to 9:00 AM, and weekends with extended hours when the reception is closed, and no staff are available (hereinafter: “Outside General Opening Hours”).

The exact opening hours of the Fitness Center are posted on the entrance door and the website.

Entry to the Fitness Center and the use of services during Outside General Opening Hours is only permitted for Guests who have a “verified account” in the AppInGym application. The technical requirements for the “verified account” and the entry and exit procedure during Outside General Opening Hours will be posted on the website.

The Service Provider reserves the right to modify the opening hours unilaterally (including shortening them), and is required to post the updated hours on the website and in the Fitness Center to inform the Guests. The Service Provider also reserves the right to close the Fitness Center for private events or other reasons.

Guests are required to comply with the modified opening hours and may not make any claims or seek compensation for changes.

The Service Provider may limit or discontinue access to certain parts of the Fitness Center or specific services, but this does not entitle the Guest to a refund of any already paid fees.

In the event of renovation, maintenance, or other reasons that prevent access to services, the Service Provider is not obligated to refund any fees paid by the Guest.

If the Service Provider is unable to deliver the agreed services, they must inform the Guest electronically within two business days based on the provided details.

Changes to the validity of tickets or passes cannot be initiated by the Guest if they were unable to use the services for any reason. If the Guest does not use the ticket for the scheduled day or the pass by its valid date, they lose the right to use the service.

In the event of a force majeure (e.g., government orders), the validity of tickets and passes will be extended by the duration of the restriction.

The Service Provider may, at its sole discretion, allow the use of a ticket or pass at a different time in cases of extraordinary circumstances (e.g., injury with medical certification).

GUEST’S RIGHTS AND OBLIGATIONS:

The Guest is required to comply with the valid Terms and Conditions, House Rules, and other applicable regulations.
